Description
Writ of error to review defendant's conviction of the crime of robbery in the first degree. Defendant contends that his conviction cannot be sustained in that (1) his arrest was invalid because made without warrant;
(2) he was held in custody for 6 days, questioned by police, and required to appear in a police "lineup," all without benefit
of counsel and before being accorded a preliminary hearing; (3) he appeared at his arraignment in the absence of his counsel
where a "not guilty" plea was entered on his behalf by the court without his consent; (4) at his trial one witness testified
as to his identity while other witnesses who later testified on this issue were permitted to remain in the courtroom; (5)
he was inadequately represented by counsel at his trial; (6) the evidence was insufficient to establish his guilt; and (7)
the court erred in certain instructions as hereinafter set forth.
