Jesse John France pled guilty to second degree theft, attempting to elude a police officer, three counts of forgery and two counts of possession of methamphetamine. The trial court sentenced France to 60 months confinement and ordered HIV testing. France appeals, arguing that RCW 70.24.340 requires HIV testing only for drug convictions where a finding of fact was made that the related drug offense was one associated with hypodermic needles, and that no such finding was made here. France was convicted of possession of methamphetamine. The trial court did not enter a finding of fact that the drug conviction was associated with hypodermic needle use.
